Terms and Conditions

1. Agreeing to these terms

These terms are an agreement between you and Potudo (“we”, “us”) about Strata Gem Sort (“the game”). By downloading or playing the game you agree to them. If you don't agree, please don't play.

You must be 13 or older to play. If you're under the age of majority where you live, a parent or guardian should review these terms with you and agree to them for you.

How we handle information is explained in our Privacy Policy, which is part of these terms.

2. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game for your own non-commercial entertainment, on devices you own or control, under these terms and the rules of the store you got it from.

You may not copy, modify, distribute, sell, rent, reverse-engineer or decompile the game, except where the law allows it regardless of these terms.

3. Coins and boosters

The game has virtual items: coins, and boosters such as hints, shuffles and undos. You can earn them by playing or by watching optional ads, or buy coins with real money.

• Virtual items are a limited licence to use them in the game. You don't own them.
• They have no cash value. They can't be exchanged for money, sold or transferred, outside or inside the game.
• They're saved to your game account in the cloud, so they follow you to a new device. If you delete your account, they're lost for good, including purchased ones. We can't restore items lost through a deleted account, or ones earned or spent before your game was last saved to the cloud.
• We may change how virtual items work, what they cost, or what they do. We'll do so reasonably and won't remove items you've paid for without good reason.

4. Purchases and refunds

Coin purchases are made through Google Play or the Apple App Store and are subject to their terms and payment rules. Prices are shown in the store before you buy.

Purchases are final once the coins are delivered, except where the law or the store's refund policy says otherwise. Refund requests go to the store you bought from: Google Play or Apple. If a purchase fails to arrive, contact us and we'll help.

Nothing in these terms limits any rights you have under consumer protection laws that can't be excluded.

5. Ads and rewards

The game shows ads, including optional ads you can watch for in-game rewards. A reward is given only when an ad is watched in full and the ad network confirms it. Ads aren't always available, and we don't guarantee a reward.

6. Your accounts

The game creates a game account for you automatically, so your progress, coins and boosters are saved in the cloud. You can delete it at any time from Settings; the Privacy Policy explains what that removes.

You can also sign in with Google Play Games or Apple Game Center, which links your game account to your devices. Those accounts belong to Google and Apple and are governed by their terms. The game works without signing in.

7. Fair play

Please play fairly. You agree not to:

• cheat, or use bots, hacks, modified versions of the game or other tools to gain an unfair advantage or obtain virtual items;
• exploit bugs, and please report them to us instead;
• interfere with the game, its security or the services it uses;
• use the game for anything unlawful.

8. Ownership

The game, including its art, music, sounds, levels, text, code and the names “Strata” and “Strata Gem Sort”, belongs to Potudo or its licensors and is protected by intellectual property laws. Apart from the licence in section 2, these terms give you no rights to them.

9. Changes to the game

We may update, change or add to the game, or stop offering it or any part of it. We'll give reasonable notice before stopping the game entirely where we can.

10. Disclaimers

The game is provided “as is” and “as available”. As far as the law allows, we make no promises that it will always be available, uninterrupted or free of errors, or that your saved progress or virtual items will never be lost.

11. Limitation of liability

As far as the law allows, Potudo isn't liable for indirect, incidental, special or consequential losses, or for loss of data, progress or virtual items, arising from the game. Our total liability to you for any claim about the game is limited to the amount you paid us for the game in the 12 months before the claim, or USD 50 if that's more.

Nothing in these terms excludes liability that can't be excluded by law, such as for fraud, or for death or personal injury caused by negligence.

12. Ending these terms

You can stop playing at any time by uninstalling the game. We may suspend or end your licence if you seriously or repeatedly break these terms. When these terms end, your licence to play and to use virtual items ends too. Sections 3, 8, 10, 11 and 13 continue to apply.

13. Governing law

These terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction over any dispute. If you're a consumer living elsewhere, you also keep the protection of any mandatory laws of your country, and may bring a claim in your local courts where those laws allow.

14. Changes to these terms

We may update these terms. We'll change the effective date above and, for significant changes, tell you in the game. If you keep playing after a change, the updated terms apply.
